The same applies to lawsuits. You must file the lawsuit within the deadline or lose your claim. The deadline, legally known as the statute of limitations (“SOL”), is the time when a lawsuit must be filed. If the deadline is passed, the right to make a claim is lost – forever.
As a general rule to bring a claim for injury in Georgia, the lawsuit must be filed two (2) years from the date of injury which caused the death of the loved one. O.C.G.A. § 9-3-31.
However, the problem with the general rule, is just that. The rule only applies sometimes, not other times. Likewise, the realworld application of the rule is also changes depending on the circumstances.
