A devastating fire tore through the Concord Crossing Apartments on Woodsong Way, just outside Smyrna in Cobb County, late Sunday night – leaving three people dead, including two children, and forcing approximately 30 residents out of their homes.
Firefighters responded around 10 p.m. and arrived to find flames billowing from a second-floor unit, threatening the apartment directly above it. Six victims were pulled from the unit and rushed to the hospital. Tragically, two children and one adult did not survive. As of Monday, a child and one adult remained in critical condition. Several additional residents had to be rescued from their balconies using ladders.
Twenty-four apartments are now uninhabitable, eight of which sustained heavy damage. Authorities have indicated the fire appears accidental, though the investigation remains ongoing. The American Red Cross Greater Atlanta Chapter stepped in to assist five displaced families.
Understanding Your Rights After a Tragedy Like This
When a fire occurs in an apartment complex, the grief of those affected is immeasurable. For families who have lost a loved one, there are also important legal questions that may arise in the weeks ahead.
Property owners and managers have a legal duty to maintain safe living conditions. That includes:
- Ensuring smoke detectors are functional
- Maintaining fire suppression systems in proper working order
- Meeting all applicable building safety codes
When those obligations are not met and a tragedy results, surviving family members may have grounds for a wrongful death claim.
These cases require careful review of:
- Maintenance and inspection records
- Building code compliance history
- The specific circumstances of the fire
An experienced wrongful death attorney can help families understand whether negligence played a role and what options may be available to them.
